On 19 October 2011, the Governor-General approved an amendment to the Administrative Arrangements Order transferring responsibilities for privacy and freedom of information policy from the Department of the Prime Minister and Cabinet to the Attorney-General’s Department.  The Privacy and Freedom of Information Policy Branch within the Department of the Prime Minister and Cabinet has transferred to the Attorney-General’s Department as the Information Law and Policy Branch.  Relevant parts of this webpage and its contents will shortly be updated and relocated to the website of the Attorney-General’s Department (www.ag.gov.au). 

FOI Guidance Notes

The FOI Guidance Notes are intended to assist agencies when considering the application of the Cabinet and deliberative documents exemptions under the Freedom of Information Act 1982 (FOI Act) when dealing with FOI requests. The notes were developed in consultation with the Australian Information Commissioner, the Freedom of Information Commissioner and the Australian Government Solicitor.  They should be read in conjunction with the Australian Information Commissioner’s Guidelines issued under section 93A of the FOI Act, to which regard must be had for the purposes of performing a function, or exercising a power, under the FOI Act.
